• Terms and Conditions

• These terms and conditions ("Terms") apply to all and any use of the Freerange website, the purchase of any products or services ("Products") using it and all and any communications made using it ("Communications").

• By using the Freerange website you agree to be bound by these Terms.

• If you do not accept these Terms you should not use the Freerange website or any part of it.

• Freerange may make alterations to these terms and conditions from time to time and these variations shall become effective immediately upon being accessible from the Freerange website.

Use of the Freerange website

• You may use the Freerange website for your private, non-commercial, personal use only.

• All email communications sent by Freerange and attachments thereto are intended only for the addressee and ⁄ or others authorised to receive them.

• By using the Freerange website you undertake that you have the necessary hardware, software and capability required for email, internet and web usage.

• Freerange may change or withdraw any part of the Freerange website, or may refuse you access to the Freerange website at any time if Freerange in its sole discretion considers it necessary.

• Freerange may also terminate this Agreement and immediately remove, cancel or suspend access to and use of the Freerange website upon breach of any part of these Terms whatsoever.

• Termination shall be without prejudice to Freerange´s other rights.

• Freerange acts as principal on its own account and not as agent for you or any other person.

• If Freerange does not enforce any provision of this agreement such will not be considered a continuing waiver.

• In the event that any part of these Terms is held to be unenforceable, such part will at Freerange´s option be construed as far as possible to reflect the parties´ intentions and the remainder of the provisions will remain in full force and effect.

• These Terms constitute the full agreement between you and Freerange and may only be amended in writing. They apply to the exclusion of all other terms or conditions of contract proposed.

• Since Freerange are principally aiming the Freerange website at the UK market, Freerange cannot and does not guarantee warrant or represent that it accords with local laws of any other countries.

• Use of the Freerange website and any dispute arising out of or in connection with these terms and ⁄ or the Freerange website shall be subject to the laws of England and the exclusive jurisdiction of the English Courts.

• Freerange has tried to make the descriptions (including all pictures) of the Products as accurate as possible but you should check the dimensions stated on the Freerange website or contact Freerange for exact sizes.

• Please check the delivered Products as soon as possible on receipt as Freerange will not cover any subsequent loss or damage.

• Freerange will provide its services with reasonable skill and care but does not give any guarantees, warranties or representations in respect of any other person´s services.

• Because of the nature of the Internet, Freerange provides and maintains the Freerange website on an "as is" and "as available" basis and makes no promise that use of the Freerange website will be uninterrupted or entirely error free. Freerange is not responsible to you if Freerange is unable to provide its Internet services for any reason beyond its control.

• Except as provided above Freerange does not give any other warranties, conditions or other terms, express or implied, statutory or otherwise and all such terms are hereby excluded to the maximum extent permitted by law.

• Third party websites with links from the Freerange website have not been verified or reviewed by Freerange and use and access of such third party websites is made at your own risk.

• You will be responsible for any breach of these terms by you and if you use the Freerange website in breach of these terms you will be liable to and will reimburse Freerange for any loss or damage caused as a result.

• These terms above shall not limit any rights you might have as a consumer that may not be excluded under applicable law nor shall they exclude or limit Freerange´s liability for death or personal injury resulting from its negligence nor any fraudulent representation.

• Freerange will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control including without limitation Internet outages, communications outages, fire, flood, war or act of God.

• Please read any documentation that comes with your Products carefully. Freerange is not involved in the manufacture of Products and will not advise on their use or operation or the manufacturer�s guidelines. You are urged to use all Products safely and in accordance with the manufacturer´s guidelines.

• Subject as aforesaid, to the maximum extent permitted by law, Freerange excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to Freerange and Freerange shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:
• any incorrect or inaccurate information on the Freerange website;
• any interruptions to or delays in updating the Freerange website;
• the infringement by any person of any Intellectual Property Rights of any third party caused by their use of the Freerange website or any Product purchased through the Freerange website;
• any loss or damage resulting from your use or the inability to use the Freerange website or resulting from unauthorised access to, or alteration of your transmissions or data in circum stances which are beyond Freerange´s control;
• any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something Freerange has done wrong;
• any amount or kind of loss or damage due to viruses or other malicious software that may infect a user´s computer equipment, software, data or other property caused by persons accessing, using or downloading the Freerange website, or from transmissions via emails or attachments received from Freerange or its licensees and affiliates;
• the availability, quality, content or nature of the other sites on the Internet that are owned and operated by third parties ("External Sites") to which Freerange link and web sites located on or through any External Site nor for any transactions involving External Sites (including as to ´cookies´, personal data, confidential information, or purchases of domain names or other services). You should contact the website administrator or webmaster for those External Sites if you have any concerns regarding such links, website or transactions;
• all representations, warranties, conditions and other terms which but for this notice would have effect.

Intellectual Property Rights

• Freerange does not give you any right or interest in any copyright or other intellectual property rights in any Product nor the right to copy them.

• The copyright, database right and other like rights in the Freerange website and the content of all the software and website pages relating to Freerange are owned by, or licensed to freerange, unless otherwise specified and may not be used, copied or altered without its express consent.

• For the avoidance of doubt, copyright extends to the design, look and feel of the Freerange website, all photo graphs on it and its marketing materials.

• You may use the Freerange website for private and personal non–commercial use only – i.e. to view, copy and print portions of the Freerangel website for the sole purpose of placing Orders. The materials on the Freerange website may not be used for any other purpose.

• Freerange and any logos it uses are trade marks of Freerange and may not be used by anyone else without its express permission.

• However, Freerange does not make any warranty or representation in respect of any other trade mark and the trade marks of any brands featured on the Freerange website belong to their respective owners.

Delivery and Returns

• Freerange delivers worldwide as per the options specified in the table below.

• After requisite credit card checks and verification of delivery ⁄ billing address, your order will be despatched as soon as possible during office hours. Orders received before 12 noon (GMT) are shipped the same day. Orders placed after 12 noon (GMT) will be shipped the next working day. Please note that orders received after 12 noon (GMT) on Friday will be shipped on Monday and will arrive on Tuesday.

• Delivery charges will be calculated on a total Order basis and you will be notified of the delivery costs automatically before you submit your credit ⁄ debit card details.

• Please check the delivered Products as soon as possible on receipt as Freerange will not cover any subsequent loss or damage.

• Freerange will make every effort to deliver by the date stated on the Freerange website or agreed via email, but Freerange will not be liable for any loss caused to you by late delivery.

• You can choose from the following delivery options:

• Freerange–fashion.com prices include UK VAT for all EU customers. For deliveries to customers outside the EU the UK VAT element will be deducted from the sale price

INTERNATIONAL DUTIES AND TAXES

• For shipping destination outside the EEC, please note that your order will be shipped exclusive of import duties and customs charges, ie, DDU (Delivered Duty Unpaid). In certain countries you may also be requested to pay additional import duties and local sales taxes at the time your order is delivered to you.

• In the event that you wish to return any item, please note that import duties and local sales taxes will not be refundable by us.

RETURNS ⁄ EXCHANGE POLICY

• We are sure you will be very happy with your Freerange purchases but we also realize that sometimes you may wish to choose another size or colour or simply change your mind, and so we operate a ‘no quibbles´ policy as explained below.

• Returns are made your own expense except where an item is faulty.

• We will only accept returns if you notify us within 7 days of receipt. Just send an email to ´enquiries@freerange-fashion.co.uk´ stating your order number in the subject line.

• Freerange will not accept returns outside of the above time frame except for faulty items.

• Freerange will only accept items that are returned in re–saleable condition. We do not accept returns for items that have been worn or where the returns tag has been removed. Please ensure you are completely satisfied with your items before removing the returns tag. Only returned items that are in the same condition as when sent from Freerange will be accepted.

• If you wish to exchange an item please notify us as above on ´enquiries@freerange-fashion.co.uk´ but put ´exchange´ in the subject line. Delivery charges on your first exchange (only) will be complimentary.

• Freerange takes a great deal of care to ensure that you receive the order of your choice in pristine condition but, if an item is faulty or not what you ordered, please email enquiries@freerange-fashion.co.uk and you will be sent the correct item (provided it is in stock or otherwise as quickly as possible) or fully refunded (including the delivery charges) whichever you prefer. Correct items will be delivered free of charge.

• After routine checks, Freerange will refund the original credit/debit card used for the purchase. This should normally be within 2 working days of receiving the returned items. Refunds include full purchase price including taxes but do not include delivery charges. Please note for international deliveries, refunds will NOT include any international shipping duties that may have been incurred.

RETURNS PROCEDURE

• Simply repackage the item securely, write the MRC number clearly on the outside and send it back to us.

• We recommend that you return items using recorded post and retain proof of postage as well as insure items, as we cannot accept responsibility for any loss during transit.

• Please note we cannot accept returns on earrings or undergarments . All skincare products must be returned completely unopened.
